Photo Contest: Rules, Terms and Conditions
Friends of Perry’s Victory and International Peace Memorial (to be referred to as The Perry Group) invite photographers to enter its 2013 Battle of Lake Erie Digital Photo Contest. You must read the following rules, terms and legal conditions before submitting any photos!
The Perry Group's 2013 Digital Photo Contest (the "Contest") is open to ALL photographers at least 18 years of age - regardless of residence or citizenship, so long as the laws of their jurisdiction allow participation.
WHAT TO ENTER:
We are looking for striking digital images to celebrate the Battle of Lake Erie Bicentennial. Your images should highlight the diversity of participants, including portraits of re-enactors, people, boats, the relationship between people and ships, and re-enactments. We are especially interested in images that showcase the moments we will remember...
Please do not include photographs of people or boats not present at the 2013 Battle of Lake Erie events. If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to The Perry Group upon request. Entrants must not submit images that involve human nudity, the willful harassment of wildlife, damage to the environment by the photographer, put any individual or animal in danger, or infringe on the rights of any other photographer or person.
All photographs should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified. Multiple exposures that have been combined to produce a single "High Dynamic Range" image are acceptable. Images that do not meet these requirements may or may not be judged at the judging panel's sole discretion.
Photo captions must accompany all submissions, and should include the subject of the image, the location the image was taken, and the name of the photographer(s).
HOW TO ENTER: CONTEST ENTRY DEADLINE PASSED
All images must be submitted though our Contest Entry Form. Complete all required fields, including name, email and other information about your photo submission.
You can select an image directly from your computer desktop, or submit images from Flickr, Facebook and Instagram for consideration in the contest. Digital images that are sent via mail or unsolicited eMail will not be accepted.
ELIGIBILITY AND JUDGING:
Entries must be a minimum of 300 DPI resolution and be submitted in one of the following Image Formats only: JPG, GIF, or PNG.
Previously published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant us a license (see "Your Rights" below). You must be able to disclose when and where the photo appeared previously to The Perry Group upon request.
Submissions may be watermarked if desired, but the watermark should be inconspicuous enough to not interfere with the judging of the photo. A watermarked photo might not be honored by the competition (at the judges sole discretion) if the photographer is unable or unavailable to provide a pristine, watermark-free version of the image when asked.
Images will be judged on originality, technical excellence, composition, overall impact and artistic merit. The judges are a panel of The Perry Group members familiar with photography and responsible for selecting images for various “Perry Group” printed and online marketing and membership materials.
The Perry Group shall determine winner eligibility in its sole and absolute discretion. All decisions made by the judges are final.
Online entries can be uploaded starting 12:01 A.M. EST on September 23, 2013. Deadline for submitting entries is 12 Noon (EST) on October 22, 2013.
Entrants may be asked to supplement their submission (such as a paragraph about their photo, the highest resolution version of their photo, or a watermark-free version of their photo) anytime on or after October 22, 2013.
Finalists will be announced in November 2013. Grand Prize Winner, 1st, 2nd and honorable mentions will be announced in early January 2014.
The Perry Group reserves the right to adjust any deadline(s) as the result of causes beyond its immediate control.
The judging panel will select approximately 50 photos to be the contest’s Finalists and Honorable Mentions.
The grand-prize winner's image will be printed on the cover of the 2014 Battle of Lake Erie Photo Book. Other finalist images will also be featured throughout the book. Winners will receive a copy of the published book.
Your photographs help The Perry Group with its mission to assist the National Park Service site “Perry’s Victory and International Peace Memorial” with fulfilling its interpretive services and historic site preservation missions. Thank you for helping to further our “ National Park Service” friends group” mission through your photography.
You will retain all rights to any photograph you submit -- including ownership if applicable. You only grant The Perry Group rights (as described below) to your photograph if you are honored by the competition as an honorable mention, finalist, runner up or grand prize winner. Before you are formally honored by the competition, The Perry Group will contact you to confirm that you wish to grant us rights to your image as described below.
If your photograph is formally honored by the competition as an honorable mention, finalist, runner up or grand prize winner, you grant The Perry Group a royalty-free, nonexclusive right, in perpetuity, to:
As conditions of this permission, The Perry Group shall credit all photographs with the caption "© Person's Name" when the full name is available.
Photo Contest: Legal Conditions
By entering, participants agree to indemnify, defend and hold harmless The Perry Group, its respective subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives, from any and all third party liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the competition (collectively, "Losses"), including without limitation any third party claim for copyright infringement or a violation of an individual’s right to privacy and/or publicity right. The Contest is void where prohibited by law.
Each entrant in the Contest (each a "Entrant") is responsible for ensuring that he or she has the right to submit the photos that he or she submits to the Contest per these rules.
You agree that any and all disputes that cannot be resolved with the Perry Group, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, before a court of competent jurisdiction located in Port Clinton, Ohio, which court shall apply the laws of the State of Ohio without regard for rules of conflicts of law. IN ANY SUCH DISPUTE, PARTICIPANT SHALL NOT BE ENTITLED TO ANY PUNITIVE, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES, OR ANY DAMAGES OTHER THAN PARTICIPANT'S ACTUAL OUT-OF-POCKET EXPENSES (IF ANY) ASSOCIATED WITH PARTICIPATING IN THE CONTEST. YOU HEREBY WAIVE ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED. The Contest and The Perry Group website are provided "as is" without warranty of any kind, either express or implied.
The Perry Group is not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the photo competition, or by any technical or human error that may occur in the processing of submissions to the photo competition, including but not limited to any misprints or typographical errors. The Perry Group assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Perry Group is not responsible for any problems or technical malfunction of any telephone network or lines, computer equipment, servers, providers, computer on-line systems, software, or failure of email on account of technical problems or traffic congestion on the Internet or at any website, including injury or damage to participant's or to any other person's computer related to or resulting from participating or uploading images or information in the photo contest.
If, for any reason, the photo competition is not capable of completion as planned, including but not limited to, any reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of The Perry Group that corrupt or affect the administration, security, fairness, integrity or proper conduct of the photo competition, The Perry Group reserves the right at its sole discretion to cancel, terminate, modify or suspend the photo competition.
